Amendment of the Sports Act
On 3 December 2019 the Act No. 6/2020 Coll. amending the Sports Act No. 440/2015 Coll. has been passed.
Application practice has shown that the impossibility of Professional athletes to perform in collective sports as self-employed is undesirable as it unreasonably limits the contractual freedom of athletes in collective sports.
Based on the amendment a professional athlete will be able to perform sporting activity for the benefit of a particular sports organization under a contract for professional pursuit of sport or as a self-employed person under a contract concluded according to the Civil Code or Commercial Code.
The proposed amendment will give sports organizations the possibility to regulate transfers of both athletes who pursue sporting activities for the benefit of a particular sports organization and those self-employed: based on a contract under the Civil Code (Article 51) or a contract under the Commercial Code (Article 269 Section 2).
